Terms and Conditions

1. Overview
These Terms and Conditions govern your use of The Black Merida Experience (“TBME”) platforms, services, and events. By creating an account, purchasing a service, attending an event, or engaging with any TBME digital property, you agree to be bound by these terms. If you do not agree, please discontinue use immediately.
TBME operates the following services and platforms, each subject to these terms:
- The TBME website (blackmerida.mx)
- The TBME Circle community platform (community.blackmexi.co)
- TBME Events, including The Social Table, Selfcare Sundays, and all other organized gatherings
- The Hive Podcast
- The Kitchen
- TBME Concierge Relocation Services (blackmerida.mx/concierge, transitioning to blackmerida.com)
2. User Conduct
All members and users are expected to engage respectfully across every TBME platform and at every TBME event. This means no harassment, discrimination, hate speech, spam, or conduct that undermines the safety, dignity, or well-being of others.
TBME is a values-driven community. Membership is extended to individuals who align with those values. We reserve the right to suspend or permanently terminate any account for conduct we determine to be inconsistent with our community standards — with or without prior notice.
3. Concierge Relocation Services
TBME’s Concierge service provides white-glove relocation support, including but not limited to immigration guidance, legal residency assistance facilitated through licensed attorneys, housing support, and related services for individuals and families relocating to Mérida, Yucatán, Mexico.
Scope of Service
Services are scoped and quoted on a case-by-case basis. No service begins until both parties have agreed to scope in writing and applicable fees have been received.
Legal Services Disclaimer
TBME facilitates connections to licensed legal professionals for immigration and residency matters. TBME itself is not a law firm and does not provide legal advice. All legal services are rendered by independent, licensed attorneys. TBME is not responsible for outcomes related to legal proceedings, government processing times, or decisions made by Mexican immigration authorities.
Sensitive Information
The nature of relocation services requires the collection of sensitive personal information, including full legal names, family member information, immigration documents, and financial details. By engaging Concierge services, you consent to the collection and use of this information to fulfill your service agreement. This data may also be used internally by TBME to inform relevant service offerings and communications. It is never sold to third parties and is handled with the highest standard of care.
Payment
All fees are outlined in your individual service agreement. Payment terms, schedules, and accepted methods will be specified at the time of engagement.
Refunds
Refund eligibility is determined on a case-by-case basis, taking into account the stage of service delivery at the time of the request. Once active work has begun on your behalf — including any third-party filings, attorney engagement, or housing coordination — fees associated with work already performed are non-refundable. TBME will make reasonable efforts to resolve disputes fairly.
4. Events and In-Person Gatherings
TBME hosts a range of events including ticketed dinners, wellness events, community gatherings, and pop-up experiences. By registering for or attending any TBME event, you agree to the following:
Liability Waiver
You release TBME, its founders, staff, partners, and affiliated venues from liability for any injury, accident, loss, or incident that occurs during or in connection with TBME events or activities.
Event Conduct
All event participants are expected to uphold TBME’s community standards. TBME reserves the right to remove any individual from an event whose conduct is deemed disruptive, harmful, or inconsistent with our values. No refund will be issued in such cases.
Ticketing and Cancellations
Event-specific refund and cancellation policies will be communicated at the time of ticket purchase. Unless otherwise stated, tickets are non-refundable within 48 hours of the event.
5. Photography, Video, and Media
TBME documents its events and community through photography and videography. By participating in any TBME event or community activity, you acknowledge and agree that:
- TBME owns all photos, videos, and media content captured at or in connection with its events and platforms.
- Your likeness may appear in this content.
- TBME reserves the right to use this content for marketing, promotional, editorial, and archival purposes without requiring individual approval or compensation.
- If you have a specific concern about your likeness in published content, contact us at hola@blackmerida.mx and we will review requests in good faith.
6. The Hive Podcast
Content produced under The Hive Podcast is the exclusive intellectual property of TBME. Guests who appear on The Hive grant TBME a perpetual, royalty-free license to publish, distribute, and promote their episode across all platforms. Guests retain the right to share their own episode but may not re-edit, repurpose, or redistribute the content without written permission from TBME.
7. Intellectual Property
All original content, branding, copy, design, and resources created by or for TBME are proprietary. This includes but is not limited to the TBME name, logo, website content, community materials, event concepts, podcast content, and photography. Unauthorized use, reproduction, or distribution of any TBME content without explicit written permission is strictly prohibited.
8. Privacy and Data
TBME maintains a separate Privacy Policy that governs how we collect, use, and protect your personal information. That policy is incorporated by reference into these Terms. By using any TBME service, you also agree to our Privacy Policy, available at blackmerida.mx.
For Concierge clients specifically: sensitive immigration and family data is collected to fulfill your service agreement and may be used internally by TBME to inform relevant service offerings and communications. This data is never sold to third parties.
9. Third-Party Platforms and External Links
TBME integrates with and links to third-party platforms including but not limited to Circle (community.blackmexi.co), Typeform, Calendly, ConvertKit, and others. TBME is not responsible for the content, policies, or practices of these platforms. Your use of third-party services is subject to their own terms and conditions.
10. Account Security
You are responsible for maintaining the confidentiality of your account credentials across all TBME platforms, including blackmerida.mx and community.blackmexi.co. Notify us immediately at hola@blackmerida.mx if you believe your account has been compromised. TBME is not liable for any loss or damage resulting from unauthorized account access.
11. Modifications to These Terms
TBME reserves the right to update these Terms at any time. When we do, the “Last Updated” date at the top of this page will change. Continued use of our platforms or services after an update constitutes acceptance of the revised terms. We encourage you to review this page periodically.
12. Governing Law
These Terms are governed by the laws of the United Mexican States and the State of Yucatán. Any disputes arising from your use of TBME services will be subject to the jurisdiction of the courts located in Mérida, Yucatán, Mexico.
